You may use the Service if you can form a binding agreement with us under the laws that apply to you. If you are a minor, you must have permission from a parent or guardian, who agrees to these Terms on your behalf and is responsible for your use of the Service.

• You're responsible for keeping your login details secure and for everything that happens under your account.
• Please give us accurate information when you sign up, and keep it up to date.
• Tell us promptly if you suspect any unauthorised use of your account.

You agree to use SmartWit only for lawful, personal, educational purposes. You agree not to:

• use the Service to cheat in a way that violates your school's or exam board's rules;
• copy, resell, or redistribute the Service or its content;
• reverse-engineer, scrape, or attempt to disrupt or overload the Service;
• upload unlawful, harmful, or infringing content;
• use the Service to harass others or to impersonate anyone.

We may suspend or close accounts that break these rules.

SmartWit is an AI-powered study aid. It teaches by talking and drawing alongside you, but:

• it can make mistakes, and you should double-check important answers;
• it is not a substitute for a qualified teacher, professional advice, or your own judgement;
• learning outcomes depend on many factors, and we do not guarantee any particular result, grade, or exam score.

• Paid plans are billed either monthly or yearly, depending on the billing cycle you choose at checkout, and renew automatically at that same interval until cancelled.
• Free trial. New subscriptions start with a 7-day free trial. We do not charge your payment method during the trial. If you cancel before the trial ends, you are not charged. If you do not cancel, your first paid billing period begins automatically when the trial ends, at the price shown when you signed up.
• Yearly plans. A yearly plan is paid in advance for twelve months of access at a discounted rate — currently the price of ten months for twelve months of access.
• Early-bird pricing. Early-bird rates are promotional and offered for a limited time. We will always show you the price you will be charged before you subscribe, and give notice before any change affects your next billing cycle.
• Prices and what each plan includes are shown on our pricing page and may change; we'll give notice of changes before they affect your next billing cycle.
• Cancelling. You can cancel at any time. Cancelling stops future renewals — it does not end the period you have already paid for, and it does not shorten it. You keep access until the end of that period: to the end of the current month on a monthly plan, or to the end of the twelve months on a yearly plan.
• Except where required by law, payments already made are non-refundable — including the unused portion of a yearly term if you cancel part-way through it.
• Certain plans may include features delivered by people (such as scheduled counselling sessions); availability of those features is subject to scheduling and reasonable use.

You keep ownership of the questions, drawings, and other content you create ("Your Content"). You grant us a limited licence to use Your Content to operate, provide, and improve the Service, as described in our Privacy Policy.

The Service, including its software, design, text, graphics, and the SmartWit name and logo, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable licence to use the Service under these Terms. Nothing here transfers any of our intellectual-property rights to you.

We work to keep the Service available and reliable, but we don't guarantee it will be uninterrupted or error-free. We may add, change, or remove features, and we may suspend the Service for maintenance or other reasons. Where reasonable, we'll give notice of significant changes.

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will meet your requirements or that its content will be accurate or complete.

To the fullest extent permitted by law, SmartWit will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or educational outcomes, arising from your use of (or inability to use) the Service. Where liability cannot be excluded, it is limited to the amount you paid us for the Service in the three months before the claim.

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably need to in order to protect the Service or other users. On termination, your right to use the Service ends, though some provisions (such as those on intellectual property, disclaimers, and liability) survive.

We may update these Terms from time to time. When we make material changes, we'll update the date above and, where appropriate, notify you in the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
